NSW Information Commissioner publishes new resource to assist regulated sectors to comply with the GIPA Act

The NSW Information Commissioner has published a new fact sheet to provide guidance to entities regulated by the Government Information (Public Access) Act 2009 (GIPA Act).

Following the IPC’s audit of universities’ compliance with contract registers in 2015, a regulatory risk with contract reporting was identified and the IPC committed to providing guidance to assist all regulated entities to comply with the requirements under the GIPA Act.

This resource has been developed in consultation with our stakeholders to assist agencies in understanding how the GIPA Act applies to agencies’ wholly-owned subsidiaries.

The GIPA Act applies to public authorities including wholly-owned subsidiaries of the Crown in right of the State or of a public authority. The GIPA Regulations can also declare entities to be public authorities.

This fact sheet provides guidance on when wholly-owned subsidiaries of agencies are captured under the GIPA Act.
