NSW public sector agencies must comply with state information and privacy laws. These laws are oversighted by the Information and Privacy Commission NSW (IPC).
- Privacy and Personal Information Protection Act 1998 (NSW) (PPIP Act)
- Health Records and Information Privacy Act 2002 (NSW) (HRIP Act)
Under the PPIP Act, the NSW public sector includes NSW government departments and statutory authorities, local councils, and universities based in NSW.
The HRIP Act also applies to NSW health service providers and organisations of a certain size that hold health information.
Under the GIPA Act, the public sector also includes NSW State Owned Corporations (SOCs).
We have a range of information on our website relating to both information access and privacy laws, including the public interest test, compliance resources, privacy management plans and more.
Please note that the IPC does not provide legal advice in any circumstance. If you are seeking legal advice, we suggest you contact LawAccess on 1300 888 529 or your local community Community legal centre or the Law Society Solicitor Referral Service on 1800 422 713.
